LUXE BIOLOGIX TERMS & CONDITIONS
These Terms & Conditions (“Terms”) govern your access to and use of luxebiologix.com and websites, portals, communications, programs, products, and non-clinical services provided or facilitated by LUXE Biologix, LLC (“LUXE Biologix,” “we,” “us,” or “our”).
Please read these Terms carefully.
By accessing the website, creating an account, completing an intake, purchasing a product or service, enrolling in a subscription or treatment program, or otherwise using the Services, you agree to these Terms and applicable policies incorporated into them.
If you do not agree, do not use the Services.
1. LUXE BIOLOGIX SERVICES
LUXE Biologix provides technology, administrative services, patient-support services, educational resources, wellness programs, and access to telehealth services that may include prescription skincare, weight-management services, metabolic or wellness services, prescription therapies, laboratory coordination, supplements, and other offerings made available from time to time.
Availability may vary based on:
- Your state and physical location
- Provider licensure
- Medical eligibility
- Applicable law and regulation
- Pharmacy availability
- Medication availability
- Laboratory requirements
- Provider medical judgment
Nothing on the website guarantees that you will qualify for a particular treatment, medication, prescription, formulation, dosage, or result.
2. NOT FOR MEDICAL EMERGENCIES
LUXE BIOLOGIX IS NOT AN EMERGENCY MEDICAL SERVICE.
Do not use the website, patient portal, email, text messaging, or other LUXE Biologix communications for a medical emergency.
If you believe you are experiencing a medical emergency, call 911 or seek immediate care at the nearest emergency department.
The Services are not intended to replace emergency medical care or all services traditionally provided through a primary-care physician or in-person healthcare professional.
3. ELIGIBILITY
Unless a particular service expressly provides otherwise, you must be at least 18 years old to independently use LUXE Biologix telehealth Services.
You agree to provide truthful, accurate, current, and complete information concerning your:
- Identity
- Age
- Physical location
- Medical history
- Current health
- Medications
- Supplements
- Allergies
- Symptoms
- Pregnancy or breastfeeding status when relevant
- Other information requested by your healthcare professional
Telehealth medical services may only be provided when you are physically located in a jurisdiction where the healthcare professional is legally authorized to provide care.
You may be asked to verify your identity and location.
4. RELATIONSHIP BETWEEN LUXE BIOLOGIX AND HEALTHCARE PROFESSIONALS
LUXE Biologix facilitates access to healthcare services but does not control the independent professional medical judgment of licensed healthcare professionals.
Medical services available through the platform may be provided by independently licensed healthcare professionals, professional medical entities, or other authorized healthcare organizations.
Healthcare professionals retain responsibility for medical decisions, including:
- Whether to establish a clinician-patient relationship
- Whether telehealth is appropriate
- Whether additional information is required
- Whether laboratory testing is necessary
- Whether an in-person examination is required
- Whether treatment is medically appropriate
- Whether a prescription should be issued
- Selection of medication or therapy
- Dosage and treatment duration
- Monitoring requirements
- Modification or discontinuation of treatment
No non-clinical employee, affiliate, referral partner, salesperson, or customer-service representative may override the professional medical judgment of a licensed healthcare professional.
5. NO GUARANTEE OF PRESCRIPTION OR TREATMENT
Payment for a consultation, intake, membership, program, or other Service does not guarantee that you will receive a prescription.
A healthcare professional may determine that:
- You are not an appropriate candidate
- Additional information is needed
- Laboratory testing is required
- An in-person evaluation is required
- A different treatment is more appropriate
- No prescription should be issued
LUXE Biologix does not guarantee a prescription, treatment eligibility, medication availability, weight loss, cosmetic improvement, health improvement, longevity outcome, or any particular clinical result.
6. TELEHEALTH
Telehealth involves healthcare delivery through electronic communications when the healthcare professional and patient are not in the same physical location.
Telehealth may include:
- Electronic health questionnaires
- Medical-record review
- Secure messaging
- Telephone communication
- Video communication
- Photographs
- Laboratory information
- Remote monitoring
- Other healthcare technology
Telehealth has benefits and limitations. A provider evaluating you remotely may not have access to all information that could be obtained during an in-person physical examination.
A healthcare professional may require in-person care or additional testing when medically appropriate.
You may also be required to review and accept a separate Telehealth Informed Consent or treatment-specific consent.
7. PRESCRIPTION MEDICATIONS
Prescription medications are available only when an appropriately licensed healthcare professional determines that a prescription is medically appropriate.
You agree to:
- Use medications only as prescribed
- Follow provider and pharmacy instructions
- Provide complete information about your health
- Disclose medications and supplements
- Disclose allergies
- Disclose pregnancy or breastfeeding status when relevant
- Notify your provider of significant changes in your health
- Report adverse reactions
- Complete medically required monitoring
Never use another person’s prescription or provide your prescription medication to another person.
If you experience a serious or potentially life-threatening reaction, seek emergency medical care.
8. COMPOUNDED MEDICATIONS
Where medically appropriate and legally permitted, a healthcare professional may prescribe a compounded medication.
Compounded medications are prepared by appropriately authorized pharmacies or facilities for particular patient needs.
Compounded medications are not FDA-approved, and the U.S. Food and Drug Administration does not review compounded drugs for safety, effectiveness, or quality before marketing in the same manner it reviews FDA-approved medications.
The treating healthcare professional is responsible for determining whether a compounded medication is medically appropriate.
Availability of compounded medications may change because of:
- Federal law
- State law
- FDA policies
- Drug-shortage status
- Pharmacy requirements
- Ingredient availability
- Supply limitations
- Other regulatory or operational factors
Neither LUXE Biologix nor a healthcare professional can guarantee the continued availability of any compounded medication, ingredient, strength, or formulation.
9. OFF-LABEL PRESCRIBING
A licensed healthcare professional may, where permitted by law and medically appropriate, prescribe an FDA-approved medication for a use, dosage, route of administration, or patient population that does not appear in the FDA-approved labeling.
This is commonly referred to as “off-label” prescribing.
The decision to prescribe a medication off-label belongs solely to the treating healthcare professional.
10. PHARMACY SERVICES
Prescriptions may be transmitted to an independent pharmacy involved in the applicable treatment program or another eligible pharmacy where permitted.
Pharmacies are independently responsible for matters within their professional scope, including:
- Prescription processing
- Medication preparation
- Dispensing
- Packaging
- Pharmacy counseling
- Quality requirements
- Applicable pharmacy laws
Medication pricing and availability may vary by pharmacy, jurisdiction, formulation, and supply.
LUXE Biologix does not guarantee pharmacy turnaround or shipping times.
11. LABORATORY TESTING
Certain treatments may require or recommend laboratory testing.
Laboratory services may be provided by independent laboratories.
You are responsible for completing required testing in accordance with your healthcare professional’s instructions.
Failure to complete medically required testing or monitoring may result in:
- Delayed treatment
- Refusal to prescribe
- Non-renewal of medication
- Modification of treatment
- Discontinuation of treatment
12. PAYMENT
You agree to pay all charges disclosed to you before purchase or enrollment.
By providing a payment method, you represent that you are authorized to use it and authorize applicable charges.
Charges may include:
- Medical consultation or provider-review fees
- Membership or program fees
- Prescription medication
- Pharmacy or fulfillment charges
- Laboratory charges
- Shipping
- Supplements or other products
- Other charges disclosed before purchase
Unless expressly stated otherwise, LUXE Biologix does not represent that Services will be covered or reimbursed by health insurance.
You are responsible for determining whether insurance reimbursement is available to you.
13. SUBSCRIPTIONS AND AUTOMATIC RENEWAL
Certain Services may be provided through recurring subscriptions, memberships, treatment plans, or medication-refill programs.
Before enrollment, applicable terms will identify the recurring price and billing frequency.
By affirmatively enrolling in recurring billing, you authorize the applicable recurring charges until you cancel.
You may cancel automatic renewal at any time.
If you enroll online, an online cancellation method will be made available where required by law.
To provide sufficient time to prevent a refill or treatment order from entering provider or pharmacy processing, we request that changes or cancellations be submitted at least 48 hours before a scheduled renewal or processing date.
However, a cancellation properly submitted before a new recurring charge has been initiated will prevent subsequent recurring charges as required by applicable law.
Cancellation does not automatically reverse charges already incurred or cancel provider services, prescriptions, laboratory services, medication preparation, or fulfillment that already occurred before cancellation.
Additional legally required renewal notices or reminders will be provided where applicable.
14. CANCELLATION AND REFUNDS
Cancellations, refunds, renewals, medication orders, and related matters are governed by the LUXE Biologix Cancellation & Refund Policy, which is incorporated into these Terms.
In general:
- Services already performed may be non-refundable
- Provider reviews and medical consultations already performed may be non-refundable
- Prescription medications may become non-refundable after pharmacy processing begins
- Dispensed or shipped prescription medication generally cannot be returned
- Medication charges may be refunded when treatment cannot be provided and the medication has not entered fulfillment, subject to applicable costs and law
Nothing in these Terms limits rights that cannot legally be waived.
15. TREATMENT, PRODUCT, AND PRICE CHANGES
Available healthcare services, providers, pharmacies, medications, formulations, doses, programs, and prices may change.
If a medication becomes unavailable or legally restricted, a healthcare professional may discuss an alternative when medically appropriate.
LUXE Biologix does not guarantee that an alternative treatment will exist or will be medically appropriate for you.
We may prospectively modify prices and program structures.
Where legally required, appropriate notice will be provided before changes to recurring charges take effect.
16. PATIENT RESPONSIBILITIES
You agree to:
- Provide accurate and complete information
- Answer medical questions truthfully
- Disclose relevant health conditions
- Disclose medications and supplements
- Follow provider instructions
- Complete required monitoring
- Use medication only as directed
- Secure your account credentials
- Report significant adverse events
- Seek emergency or in-person care when appropriate
- Not obtain treatment through fraud or deception
Knowingly providing false or materially incomplete medical information can create serious health risks and may result in termination of access to Services.
17. ACCOUNT SECURITY
You are responsible for maintaining the confidentiality of your username, password, authentication information, and devices used to access the Services.
You may not permit another person to impersonate you or complete medical intake information on your behalf unless authorized by law and accepted by the applicable provider.
Notify us promptly if you believe your account has been accessed without authorization.
18. ELECTRONIC COMMUNICATIONS
You consent to receive electronic communications relating to Services you request, including email, portal communications, and electronic notices.
Where permitted by law, you agree that electronic communications satisfy requirements that notices or disclosures be provided in writing.
19. TEXT MESSAGING
If you provide your mobile number and consent to text messaging, LUXE Biologix and service providers acting on our behalf may send messages regarding:
- Appointments
- Accounts
- Orders
- Prescription administration
- Shipping
- Treatment-related administrative matters
- Customer service
Where you separately consent to promotional text messages, marketing messages may also be sent.
Message frequency varies. Message and data rates may apply.
Reply STOP to discontinue applicable messages and HELP for assistance.
Consent to promotional text messages is not a condition of purchase.
20. AFFILIATES AND REFERRAL PARTNERS
LUXE Biologix may operate referral or affiliate programs involving aesthetic, wellness, fitness, beauty, healthcare, or other professionals or businesses.
Eligible referral partners may receive compensation.
A referral or affiliate relationship does not authorize an affiliate to make medical decisions for LUXE Biologix patients.
Unless independently licensed and acting within an appropriate professional relationship, affiliates may not:
- Diagnose patients
- Prescribe medication
- Select patient treatment
- Alter provider instructions
- Guarantee medical eligibility
- Guarantee prescriptions
- Exercise medical judgment on behalf of a treating healthcare professional
Medical decisions remain with the appropriately licensed healthcare professional.
21. EDUCATIONAL INFORMATION
Articles, FAQs, treatment descriptions, videos, website information, social-media content, emails, and marketing materials are provided for general informational and educational purposes.
They are not individualized medical advice and do not create a healthcare professional-patient relationship.
General descriptions of potential benefits do not guarantee that treatment is appropriate for you or that you will experience any particular result.
22. SUPPLEMENTS, SKINCARE, AND NON-PRESCRIPTION PRODUCTS
LUXE Biologix may offer dietary supplements, skincare products, wellness products, and other non-prescription goods.
Unless otherwise expressly stated, dietary supplements are not intended to diagnose, treat, cure, or prevent disease.
Consult an appropriate healthcare professional before using supplements if you have medical conditions, take medications, are pregnant or breastfeeding, or are preparing for surgery.
23. INTELLECTUAL PROPERTY
The website and its content, including trademarks, names, graphics, photographs, videos, designs, text, software, educational materials, logos, and other intellectual property, belong to LUXE Biologix or its licensors and are protected by applicable intellectual-property laws.
You receive a limited, non-exclusive, non-transferable, revocable right to use the Services for your personal lawful use.
Without written authorization, you may not:
- Reproduce protected materials
- Sell or sublicense them
- Scrape the website
- Commercially exploit website content
- Reverse engineer protected technology
- Create unauthorized derivative works
24. TESTIMONIALS, REVIEWS, AND USER CONTENT
If you voluntarily submit a review, testimonial, photograph, feedback, comment, or other content for public or promotional use, you represent that you have authority to provide it.
LUXE Biologix will not knowingly publicly disclose identifiable protected or sensitive health information for promotional purposes where applicable law requires authorization unless appropriate authorization has been obtained.
Testimonials reflect individual experiences and do not guarantee that another patient will achieve the same results.
25. PROHIBITED CONDUCT
You may not:
- Use the Services unlawfully
- Submit fraudulent medical information
- Attempt to obtain medication through deception
- Impersonate another person
- Transfer prescription medication to another person
- Attempt unauthorized account access
- Interfere with platform security
- Introduce malicious software
- Scrape or harvest protected information
- Use the Services for unauthorized commercial resale
- Threaten or harass providers, employees, or users
- Violate the rights of LUXE Biologix or others
26. THIRD-PARTY SERVICES
The Services may integrate with independent healthcare professionals, pharmacies, laboratories, payment processors, shipping companies, communications providers, and other organizations.
Third parties may be governed by their own terms and privacy policies.
LUXE Biologix is not responsible for the independent acts or omissions of third parties except to the extent responsibility cannot lawfully be disclaimed.
27. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND NON-CLINICAL LUXE BIOLOGIX SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
LUXE BIOLOGIX DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR AVAILABLE AT ALL TIMES.
LUXE BIOLOGIX DOES NOT GUARANTEE ANY PARTICULAR HEALTH, AESTHETIC, WEIGHT-MANAGEMENT, WELLNESS, OR OTHER RESULT.
Nothing in this provision eliminates professional duties independently owed to you by a licensed healthcare professional.
28. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUXE BIOLOGIX AND ITS OWNERS, OFFICERS, EMPLOYEES, AND NON-CLINICAL SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE WEBSITE OR NON-CLINICAL SERVICES.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Nothing in these Terms is intended to improperly eliminate or restrict rights concerning medical malpractice, professional negligence, healthcare liability, or other duties independently owed by a licensed healthcare professional.
29. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless LUXE Biologix from claims, liabilities, losses, and reasonable expenses arising from:
- Your unlawful misuse of the Services
- Your violation of these Terms
- Fraudulent information you provide
- Unauthorized use of another person’s account
- Your infringement of another person’s rights
This provision does not require a patient to indemnify a healthcare professional for professional negligence or liability that cannot legally be transferred to the patient.
30. INFORMAL DISPUTE RESOLUTION
Before filing or commencing a non-medical dispute against LUXE Biologix, you and LUXE Biologix agree to make a good-faith effort to resolve the dispute informally for at least 30 days.

31. ARBITRATION OF CERTAIN NON-MEDICAL DISPUTES
Except for claims expressly excluded below, disputes arising from the LUXE Biologix website, payment administration, subscriptions, intellectual property, marketing, or other non-medical platform services that cannot be resolved informally may be resolved through binding individual arbitration administered by the American Arbitration Association under applicable consumer arbitration rules, subject to applicable law.
Small-claims matters eligible to be brought in an appropriate small-claims court may instead be pursued there.
To the maximum extent permitted by law, claims subject to this arbitration provision will be resolved individually rather than through class, collective, consolidated, or representative proceedings.
Healthcare Liability Claims Are Excluded
This website arbitration provision does not require arbitration of a medical malpractice claim, professional negligence claim, healthcare liability claim, or claim based upon the clinical judgment or professional healthcare services of a licensed healthcare professional where applicable law imposes additional requirements for an agreement to arbitrate such a claim.
For Texas patients, this provision is specifically not intended to operate as an agreement requiring arbitration of a “health care liability claim” governed by Chapter 74 of the Texas Civil Practice and Remedies Code.
Arbitration Opt-Out
You may opt out of this non-medical arbitration provision by emailing hello@luxebiologix.com within 30 days after first accepting these Terms.
Your request must include:
- Your full name
- The email associated with your account
- A clear statement that you are opting out of the arbitration provision in the LUXE Biologix Terms & Conditions
32. GOVERNING LAW
Except where federal law or the law of another jurisdiction requires otherwise, these Terms and non-medical disputes involving LUXE Biologix will be governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Clinical care remains subject to the laws and professional requirements applicable to the jurisdiction where the patient is located and the healthcare professional is authorized to practice.
33. TERMINATION
LUXE Biologix may suspend or terminate access to non-clinical Services where reasonably necessary because of:
- Fraud
- Misuse
- Threats or harassment
- Unlawful conduct
- Security concerns
- Nonpayment
- Material violations of these Terms
Where an established healthcare professional-patient relationship exists, treatment decisions and professional termination obligations remain subject to applicable healthcare laws and professional standards.
34. CHANGES TO THESE TERMS
We may update these Terms to reflect changes in our Services, business practices, or legal obligations.
The “Last Updated” date above identifies the latest revision.
Where required by law, notice will be provided before material changes become effective.
35. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain effective.
36. NO WAIVER
Failure to enforce a provision of these Terms does not waive the right to enforce it later.
37. ENTIRE AGREEMENT
These Terms, the LUXE Biologix Privacy Policy, Consumer Health Data Privacy Policy, Cancellation & Refund Policy, applicable informed consents, treatment-specific disclosures, and other terms expressly incorporated into them constitute the applicable agreement concerning LUXE Biologix’s Services.
Separate agreements may govern your relationship with a healthcare professional, medical group, pharmacy, laboratory, or other independent organization.
